Whitecap Dakota First Nation has developed and enforces its own laws under the Framework Agreement on First Nations Land Management. Current laws enacted at Whitecap are both under the authority of the WDFN Land Code and the Indian Act. 

Following is a list of WDFN Laws and Bylaws: 

WDFN Indian Act Bylaws
  • WDFN Business License Bylaw provides the form, fee and procedure for the issuance of a business license to business owners operating on Whitecap lands. 
  • WDFN Smoking Bylaw regulates and prohibits smoking in enclosed places on Whitecap lands. It also outlines the penalties and violations thereof. 
  • WDFN Waste Disposal and Burning Bylaw was established for the purpose of protecting the health of residents and the prevention of nuisances where waste and burning is involved. 

WDFN Land Laws 

  • WDFN Land Code sets out the principles, rules and structures that apply to Whitecap lands and resources. The authority to create land laws is derived from the land code. 
  • WDFN Matrimonial Real Property Law, 2004 is a requirement under the WDFN Land code to set out the rules and procedures applicable on the breakdown of marriage, to the use, occupancy and possession of Whitecap land and the division of interests in the land. 
  • WDFN Law Respecting Traditional Interests, 2008 establishes an orderly regime for granting and administration of traditional land on Whitecap lands. 
  • WDFN Ratification Land Law, 2015 sets out the ratification process to be followed when a ratification vote is required by the WDFN Land Code. 
  • WDFN Environmental Protection Law, 2018 ensures that Whitecap lands are protected to the same environmental standards as the rest of the Province by incorporating and adopting certain sections of Saskatchewan laws. 
  • WDFN Land Use Law, 2019 regulates development on Whitecap lands to ensure development is compatible with surrounding land uses. The law also covers zoning, development processes, signage and fencing requirements. 
  • WDFN Interim Pandemic Law, 2020 provides for the protection of Whitecap lands, the environment, the health and safety of the members, residents and their families by imposing measures to reduce the risk of the spread of COVID-19 in the community. 
  • WDFN Cannabis Law, 2022 sets out the principles, legislative and administrative structures that apply to WDFN lands and through which the First Nation will exercise its authority over Cannabis-related activities over those lands.
